TERMS & CONDITIONS
Article 1. Definitions
The following definitions apply to the terms and conditions:
• The cult of tomorrow: Kerkbuurt 110, 1511 BG, Oostzaan, The Netherlands (CoC: 80402763, VAT: NL003440687B73)
• Customer: The person who reaches an agreement with The cult of tomorrow and does not trade in occupation or business
• Product: All business offered and presented by The cult of tomorrow on its website.
Article 2. General
These conditions apply to all sales and agreements between The cult of tomorrow and the customer, whereby The cult of tomorrow will apply these conditions unless agreed otherwise in writing. If articles are ordered from The cult of tomorrow, the customer automatically accepts the stipulations set out in these General Terms and Conditions.
Article 3. Orders
Once an order has been placed, the customer will directly receive an email to confirm the details of the order and the total costs associated with the order. Orders are usually shipped within 5 working days after payment is received, unless indicated otherwise. In the case of technical malfunction, however, which falls under the category of circumstances beyond The cult of tomorrow’s control, an order will be shipped as soon as possible. The cult of tomorrow will keep the customer duly informed of the status of the order. We strive to keep our website (www.thecultoftomorrow.com) as current as possible. However, the possibility remains that a certain product is no longer available, in which case we will contact the customer and the purchase price will be refunded as soon as possible.
When the order is not shipped within 2 weeks after payment, the customer has the right to cancel the order and the purchase price will be refunded as soon as possible. The cult of tomorrow reserve the right to cancel or decline an order in which case The cult of tomorrow communicates this within 1 week after receipt of the order.
Article 4. Prices and payment
All prices indicated on the website of The cult of tomorrow are in Euro’s and include value added tax (VAT). Shipping costs depend on delivery location and will be added to the invoice of the order. Customers are able to make payments electronically in many different ways. Information about the differing payment methods and shipping costs are indicated on the website under the ‘Delivery and Payment’ section.
Customer is responsible for customer clearance, import/export duties and providing a correct delivery address including correct address name / company name. Any risk or additional costs that occur due to wrongly provided address details, customer clearance and/or import/export duties are for customer’s account.
Article 5. Delivery
Delivery times are indicative and is therefore not guaranteed. Orders are usually shipped within 5 working days after the payment has been received, and will not exceed more than two weeks, excepting cases of ‘Force Majeure’. The cult of tomorrow cannot be held responsible if the postal service is unable to deliver the order to the customer on time or in case orders are delayed at customs.
In case a parcel cannot be delivered due to a wrongly provided address (by the customer or in case the parcel is not collected by the customer at the pick-up-location the costs for re-sending the parcel will be charged to the customer.
Article 6. Transfer of ownership
Ownership of products will not be transferred until the associated obligations of customer have been fulfilled. At the point of transfer of ownership, which is at the point of delivery of the products, product liability is transferred to the customer.
Article 7. Returns
If the customer, for whatever reason, does not wish to retain the article, the customer has the right to return the article to The cult of tomorrow within thirty working days after taking delivery of the article. The customer shall use the Return Portal or inform The cult of tomorrow via email of their intention to return the goods and follow all further return conditions and instructions stipulated by The cult of tomorrow. More information can be found at “Return & Exchange” on the website.
Returns will only be accepted when the product packaging is undamaged, and the product is unworn, unwashed, undamaged and with original labels attached. The cult of tomorrow has the right to deduct any impairment of value from the refund.
Shipping costs, import/export duties and administration costs related to the returned products will be entirely paid for by the customer and if necessary be deducted from the return payment.
Article 8. Queries, complaints and defects
In the case of queries or complaints concerning any of our products or procedures, please inform us by e-mail. You will receive a reply within five working days. Defects must be reported to us as soon as possible after the product was delivered (but within 5 calendar days) via e-mail (customercare@thecultoftomorrow.com).
The cult of tomorrow will examine the defect and will exchange the product or offer you to return it for a refund if the defect is found accurate.
Article 9. Liability
The cult of tomorrow cannot be held responsible or accept any liability for direct or indirect damages in any form or whatsoever, either physical, material or immaterial, that can be caused by (wrong) use or mailfunction of The cult of tomorrow products.
The cult of tomorrow cannot be held responsible or accept any liability for the consequences of incorrect or incomplete information on the website, including any typing or misprinting errors that could communicate an incorrect selling price.
The cult of tomorrow cannot be held responsible or accept any liability for the content of third-party websites that can be accessed via links on The cult of tomorrow website.
Article 10. Privacy and cookies
All personal information of the customer is used exclusively for the processing of the order, sending newsletters and/or marketing-related materials and personalize your website experience. Personal Information will never be shared with or available to third parties, except when the information is required for the payment and delivery of the product. Use of cookies and records of website visits are anonymous kept for statistical purpose, internal research and website improvement. Article 11. Force majeure
The cult of tomorrow reserves the right in the case of ‘Force Majeure’ to suspend or cancel the execution of an order without legal intervention and cannot accept any liability for damages, unless under the circumstances this is unacceptable according to measures of reason and fairness. The customer will in case of ‘Force Majeure’ be informed about the reason and next steps in writing.
Force Majeure means every shortcoming that cannot be allocated to The cult of tomorrow, because it is not due to her fault and beyond her control and according to the law not accounted to her.
Article 12. Copyright
All information on the website of The cult of tomorrow is protected by copyright. It is illegal to copy, use or distribute any information from The cult of tomorrow’s website without first acquiring written permission. Visitors and users of The cult of tomorrow’s website may not claim any rights pertaining to the information on the website. None of the text or graphics from The cult of tomorrow’s website may be partially or wholly copied or publicly used for printing, photocopying, faxing, overtyping, in an electronic database, or for any other reproduction purposes.
Article 13. Applicable law and competent court
To all laws, obligations, proposals, offers, orders, and agreements, to which these terms and conditions are applicable, as well as these conditions, solely Dutch law is applicable. All disputes between parties will exclusively be presented to the competent court in Amsterdam.
Article 14. Acceptance of general conditions
All website users are required to be aware of, and to agree with, all of the above terms and conditions. By placing an order with The cult of tomorrow the customer automatically agrees to all of our terms and conditions.
